1-3. The Lord spake unto Joshua . . . Appoint out for you cities of refuge —(See Numbers 35:9-28 ; Deuteronomy 19:1-13 ). The command here recorded was given on their going to occupy their allotted settlements. The sanctuaries were not temples or altars, as in other countries, but inhabited cities; and the design was not to screen criminals, but only to afford the homicide protection from the vengeance of the deceased's relatives until it should have been ascertained whether the death had resulted from accident and momentary passion, or from premeditated malice. The institution of the cities of refuge, together with the rules prescribed for the guidance of those who sought an asylum within their walls, was an important provision, tending to secure the ends of justice as well as of mercy. return to ' Top of Page ' <a name="verse-4" class="com-number"

1-3. "여호와께서 여호수아에게 말씀하시되 … 도피성들을 … 정하라" — (민 35:9-28; 신 19:1-13 참조). 여기 기록된 명령은 각 지파가 배정받은 정착지로 이동할 때 주어졌다. 피난처들은 다른 나라에서처럼 신전이나 제단이 아닌 거주하는 성읍들이었다. 그 목적은 범죄자들을 보호하는 것이 아니라, 죽음이 사고나 순간적 격분에서 비롯된 것인지, 아니면 계획적인 악의에서 비롯된 것인지를 확인할 때까지 피살자의 친족들의 복수심으로부터 실수로 살인한 자를 보호하기 위한 것이었다. 도피성 제도 및 그 안에 피신한 자들을 위한 규정들은 자비뿐만 아니라 정의의 목적을 이루는 데 있어 중요한 제도였다.

4. he that doth flee unto one of those cities shall stand at the entering of the gate of the city —It was the place of public resort, and on arriving there he related his tale of distress to the elders, who were bound to give him shelter and the means of support, until the local authorities ( :- ), having carefully investigated the case, should have pronounced the decision. 4. "성문으로 도망쳐 온 자는 그 성읍의 장로들의 귀에 자기의 일을 알릴 것이요" — 성문은 공개적인 집회 장소였다. 거기 도착하여 자신의 딱한 사정을 장로들에게 이야기했고, 장로들은 그에게 피신처와 생필품을 제공할 의무가 있었다. 지역 당국이 사건을 신중하게 조사하여 판결을 내릴 때까지였다. 유죄로 밝혀지면 살인자는 복수자에게 넘겨졌다. 정상 참작 사유가 나타나면 성읍 안에 머물면서 쫓아온 자들의 복수심으로부터 안전하게 지낼 수 있었다. 그러나 성벽 밖으로 나가는 순간 면책 특권을 잃었다.

6. until the death of the high priest —His death secured the complete deliverance of the manslayer from his sin, only because he had been anointed with the holy oil ( Numbers 35:25 ), the symbol of the Holy Ghost; and thus the death of the earthly high priest became a type of that of the heavenly one ( Hebrews 9:14 ; Hebrews 9:15 ). In the first instance, they were a provision of the criminal law of the Hebrews, necessary in the circumstances of that people (see on :- ; :- ).
